Mile High Compounds Affiliate Program Terms of Service
Last Updated: March 29th, 2026
These Terms of Service (“Terms”) govern participation in the Mile High Compounds Affiliate Program (the “Program”) operated by Mile High Compounds (“Company”, “the Company”, “we”, “us”, or “our”). By applying to or participating in the Program, you (“Affiliate”, “you”, or “your”) agree to be bound by these Terms.
To participate in the Program, you must submit a complete application through the designated application process. Approval is at Company’s discretion, and Company may accept or reject any application for any lawful business reason, including concerns about your website, social media presence, audience, brand alignment, or marketing practices.
Company may request additional information before making a decision. Submission of an application does not guarantee acceptance, and no affiliate relationship exists unless and until the Company approves your application in writing.
Upon approval, the Company provides you with unique affiliate link and coupon code for use in promoting Company products. All affiliate link and coupon code issued or provided by the Company are and shall remain the sole property of the Company. No ownership, intellectual property right, or other proprietary interest in any such link and code is granted or transferred to the Affiliate.
Each such link or code is issued solely for the Affiliate’s authorized participation in the Program. The Affiliate may use such link or code only in accordance with these Terms and any instructions provided by the Company.
The Company retains the exclusive right to deactivate, modify, replace, reassign, reuse, or otherwise control any affiliate link or coupon code at any time, including after an Affiliate’s suspension or termination from the Program.
The Affiliate is responsible for using all link and code accurately and may not alter, obscure, mask, sublicense, rebrand, misrepresent, or otherwise modify them without the Company’s prior written approval.
A sale is generally eligible for commission only if it is properly tracked through an approved affiliate link or coupon code completed and paid in full, and not subsequently refunded, disputed, charged back, or otherwise excluded under the Agreement or Commission Structure and Payment Terms Addendum. Ownership of an affiliate link or coupon code by the Company does not, by itself, create any continuing right to commissions after the Affiliate’s participation in the Program has ended.
You agree to promote the Company in a professional, lawful, and truthful manner. You will not make false, misleading, or unsubstantiated claims regarding the Company, its products, pricing, ingredients, performance, results, or policies.
Without limiting the generality of the foregoing, you may not:
If the Company provides a coupon code, the code must be displayed in its full approved form, together with any approved offer description, expiration date, and applicable limitations. You may not shorten, change, combine, misstate, or imply broader terms than those approved by the Company.
Coupon codes may be used only in approved promotional contexts. Unless Company gives prior written approval, you may not:
If Company reasonably determines that a coupon code has been leaked, misused, reposted outside approved channels, or associated with suspicious activity, Company may disable the code, issue a replacement code, adjust attribution, or place related commissions under review. The Company will generally provide notice where practical and may ask you to help identify the source of the issue.
You may not use your affiliate link or coupon code to generate commissions on your own purchases, or on purchases made by persons in your household or by accounts controlled by you. You may not create or use fake identities, duplicate accounts, or other methods intended to generate unearned commissions.
The Company may monitor affiliate activity, coupon code usage, order patterns, referral sources, and related records to protect the integrity of the Program and to verify commission eligibility. If Company reasonably believes there has been self-referral, coupon abuse, or other misuse, the Company may revoke the related commission, suspend the applicable code or account, or take other reasonably necessary action.
You may use Company-approved marketing materials, product descriptions, images, and branding solely for the purpose of promoting Company under these Terms. Any use of Company trademarks, logos, or brand elements must be accurate, professional, and consistent with Company’s brand guidelines, if provided. You may not register domains, social handles, ad accounts, or other identifiers containing Company’s name or confusingly similar terms without Company’s prior written consent.
During the term of your participation, you may receive non-public information relating to Company or the Program, including coupon codes not yet released, promotional plans, commission structures, pricing, performance data, internal policies, technical information, and non-public business materials (“Confidential Information”). If information provided to you is Confidential Information, it will contain the verbiage CONFIDENTIAL or CONFIDENTIAL INFORMATION. If at any point Affiliate is unsure if the information is classified as confidential, the Affiliate must treat that it confidential until validated otherwise.
You agree to keep Confidential Information confidential and to use it only as needed to perform under these Terms. You may not disclose Confidential Information to any third party except as reasonably necessary for your own approved promotional activities or as required by law.
Confidential Information does not include information that:
You must take reasonable steps to protect Confidential Information from unauthorized access, disclosure, or misuse.
You agree not to make knowingly false statements or statements made with reckless disregard for the truth about the Company, its owners, employees, products, policies, or business practices in a public or commercially harmful manner.
This section is intended to protect the parties’ business reputation and does not prohibit truthful statements, honest opinions, ordinary product reviews, or disclosures required by law. Nothing in these Terms is intended to restrict lawful reporting to government authorities or participation in any legal process.
Commission rates, payout thresholds, payment methods, payout timing, holdbacks, reversals, and related payment administration are governed exclusively by the Mile High Compounds Affiliate Program Commission Structure and Payment Terms Addendum, and as such, may be amended from time to time.
You agree to comply with all applicable laws, rules, and regulations, including advertising, marketing, disclosure, consumer protection, and privacy laws. If required by applicable law or platform rules, you must clearly disclose your affiliate relationship in a conspicuous manner.
You are solely responsible for obtaining any approvals, consents, filings, or registrations required for your own promotional activities.
These Terms remain in effect until terminated. The Affiliate may terminate participation in the Program at any time by providing written notice to the Company. The Company may suspend or terminate an Affiliate’s participation in the Program at any time, with or without cause, by written notice.
The Company may also immediately suspend or terminate an Affiliate’s participation if it reasonably believes the Affiliate has violated these Terms, engaged in fraud or abuse, misused affiliate links or coupon codes, or otherwise engaged in conduct that may harm the Program, Company, or its customers.
Upon suspension or termination, the Affiliate must immediately stop using all affiliate link and coupon code and Company branding unless the Company expressly directs otherwise in writing. The Company may thereafter deactivate, modify, reassign, reuse, or otherwise control any affiliate link or coupon code previously issued to the Affiliate.
The Affiliate shall have no right to commissions arising from orders placed or sales generated after the effective date of the Affiliate’s suspension, termination, or deactivation from the Program, regardless of whether a previously issued affiliate link or coupon code remains active or is subsequently used by a customer.
Any commissions properly earned from qualifying sales occurring before the effective date of termination, and which are not subject to a hold, reversal, adjustment, dispute, refund, chargeback, or other exclusion under the Agreement or Commission Structure and Payment Terms Addendum, will be handled in accordance with the applicable payment terms.
For the avoidance of doubt, continued use, reassignment, or reuse of an affiliate link or coupon code by the Company after termination does not create any continuing commission entitlement for the former Affiliate.
The Company may modify these Terms from time to time. Changes will become effective when posted in the affiliate portal, sent by email, or otherwise communicated to you. Your continued participation in the Program after the effective date of any change constitutes your acceptance of the updated Terms.
If you do not agree to a modification, your sole remedy is to stop participating in the Program by notifying us via email or written communication within 72 hours of modifications.
To the fullest extent permitted by law, Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program. The Company’s total liability for any claim arising under these Terms will not exceed the total commissions actually paid to you during the three months immediately preceding the event giving rise to the claim.
You are an independent contractor and not an employee, partner, joint venturer, agent, or representative of the Company. You have no authority to bind Company or to make representations on Company’s behalf unless Company expressly authorizes you in writing.
You are responsible for your own taxes, reporting obligations, insurance, permits, and business expenses unless the Company agrees otherwise in writing.
These Terms will be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law rules.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. The Company’s failure to enforce any provision on one occasion will not be deemed a waiver of its right to enforce that or any other provision later.
These Terms, together with the Commission Structure and Payment Terms Addendum and any other documents expressly incorporated by reference, constitute the entire agreement between you and Company concerning the Program and supersede prior or contemporaneous discussions or understandings regarding the Program, unless Company and you sign a separate written agreement stating otherwise.
The following provisions will survive the termination or expiration of these Terms for any reason for 3 years post-termination:
Survival of these provisions does not imply any obligation on Company to continue paying commissions beyond the period and conditions expressly set forth in the agreement or the Commission Structure and Payment Terms Addendum.
By participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Addendum to Mile High Compounds Affiliate Agreement
Commission Structure and Payment Terms
Effective Date: April 1st, 2026
This Commission Structure and Payment Terms Addendum (“Addendum”) is incorporated into and made part of the Mile High Compounds Affiliate Program Terms of Service (the “Agreement”) between Mile High Compounds (“Company”) and the affiliate participant (“Affiliate”). If there is any conflict between this Addendum and the Agreement, this Addendum controls only with respect to commission, payout, and related payment terms.
Subject to the terms of the Agreement and this Addendum, Company will pay Affiliate a commission equal to 10% of qualifying net sales properly attributed to Affiliate through Company’s approved tracking methods.
A sale qualifies for commission only if all of the following apply:
To be eligible for a commission, orders must be placed directly by the end customer using their own account, payment method, and shipping details. Our affiliate policy strictly prohibits placing orders on behalf of clients. Self-referrals and orders placed on behalf of clients will result in forfeited commissions.
The Company will determine qualifying sales based on its records and tracking systems, acting in good faith and with commercially reasonable administration of the Program.
For purposes of this Addendum, “net sales” means amounts actually received by Company for the applicable order, less any refunds, chargebacks, credits, cancellations, taxes, shipping charges, and any discounts or adjustments not approved by Company for commission purposes.
Cash payouts on Commissions will become payable only after Affiliate’s accrued commission balance reaches $100, unless the Company agrees otherwise in writing. Amounts below the threshold may at the Company’s Discretion:
Subject to review for fraud, returns, chargebacks, or other adjustments, the Company will generally process payouts monthly on or around the 10th day of the month for commissions from the previous month. This is to limit chargebacks and adjustments after the payout has occurred.
Company may offer one or more payment methods, which may include:
The Company may change available payment methods from time to time on reasonable notice. If an affiliate elects to receive payment by wire transfer, a $25 wire fee will be deducted from the payout amount. Affiliate is responsible for any additional bank fees charged by the receiving institution, intermediary bank, or correspondent bank, if applicable.
Company may reasonably hold, adjust, or reverse commissions to reflect:
If Company withholds or adjusts a payment, Company will use reasonable efforts to identify the reason for the hold and to release any amount that is ultimately determined to be payable.
Company’s records will control commission calculations unless Affiliate can provide clear and reasonable evidence of an error. Any dispute regarding a commission payment should be submitted in writing within a reasonable time after the payout statement is issued.
The Company may modify the commission rate, payout threshold, payment methods, or other commercial terms of this Addendum from time to time upon notice through the affiliate portal, email, or another reasonable method. Changes will apply prospectively unless otherwise stated in writing.
